Berkeley Burke

If you moved your pension into a Berkeley Burke SIPP you may want to check if you should be claiming compensation for mis-selling

Many investors were given poor or mis-leading advice when it came to transferring money from their personal pension into a Berkeley Burke SIPP.

As with most mis-sold SIPPs the problem can be with the investments within the SIPP and the advice given to transfer into them.

Who’s to blame for SIPP mis-selling?

Mis-sold pension compensation claims have mainly been directed at regulated financial advisers for giving negligent financial advice to their clients.

However, Berkeley Burke have also been subject to some high-profile court cases, which are challenging the right to make claims against SIPP providers.

Court Case 1

In 2014 the Financial Ombudsman Scheme (FOS) ruled against them in respect of the Sustainable Agro Energy investment. This was a green biofuel project in Cambodia which subsequently went into receivership after the Serious Fraud Squad got involved!

Berkeley Burke took this decision to court and in 2018 the Judge ruled in favour of the FOS in the high court judicial review case.

However, they won the right to appeal this decision which was scheduled for October 2019.

This did not go ahead as they decided to withdraw their appeal case due to a lack of funds.

Court Case 2

This court case involved a collective of 176 investors who claimed they suffered losses as a result of the high-risk assets within their SIPPs.

The plaintiffs alleged they were sold these SIPPs through 9 different introducer firms and as a result were invested in single high-risk investments ranging from forestry schemes to overseas property.

Berkeley Burke withdrew their defence in this case, in order to focus on the FOS court case proceedings.

A thoroughly positive result and experience. In all honesty I didn't have much hope of any success following a truly dodgy pension investment. I spent years angry at myself then decided to let these guys have a go on my behalf. It took hardy any effort on my part and they kept me fully informed, then out of the blue I got a call saying they have won all my pension back plus more and within days it hit my account. Thrilled with their effort and professionalism. I dealt with a few different staff and all were informative, polite and helpful. I great end to a terrible situation. 100% genuine review and I cannot recommend them enough. Thank you.

I was approached by Pension Claim Consulting after the company that was handle ing my SIPP had been investigated by the Financial Ombudsmen and informed me i had a case, with this information given to me i agreed to let them represent me in trying to reclaim my investment. All through the process i was informed of every step and on a regular basis even though it took many months the outcome was successful and i was reimbursed fully. This is a fantastic company to work with and dedicated staff who know their business. Many Thanks. Mike Dixon.
